Eligibility

You must be at least 16 years old to use the Service. By using Tilkly you confirm you meet this requirement.

Section 2

Your Account

  • You are responsible for keeping your login details safe and for all activity under your account.
  • Notify us immediately at support@tilkly.com if you suspect unauthorised access.
  • One account per person. You may not share, transfer, or sell your account.
  • Tilkly has no subscription or paid feature level. The main features are included within one fair-use allowance for your published website, and you will never receive an automatic extra-use bill.

Section 3

Acceptable Use

You may use Tilkly to create and publish websites for lawful purposes. You agree not to:

  • Publish unlawful, harmful, defamatory, obscene content, or content that violates someone else’s intellectual property rights.
  • Use the Service to send spam or conduct phishing or fraudulent activities.
  • Try to break into, copy the inner workings of, or disrupt Tilkly or another user’s website.
  • Collect information from Tilkly in bulk without our written permission.
  • Publish content that violates export control or sanctions regulations.
Section 3a

Strictly Prohibited Content

Publishing any of the following results in immediate account suspension and deletion without notice or refund.
  • Fake sign-in or payment pages - pages that pretend to be a bank, payment service, government service, or another login page to steal passwords or payment details.
  • Harmful downloads - hosting or linking to viruses or any software designed to harm people, devices, or information.
  • Content shared without permission - links or copies of films, music, software, books, or other work shared in breach of copyright.
  • Brand impersonation - sites presenting as the official property of another company, public figure, or government agency without authorisation.
  • Illegal goods and services - controlled substances, unauthorised weapons sales, human trafficking, or any content violating criminal law.
  • Adult content involving minors - zero tolerance. Such content will be reported to law enforcement.
  • Incitement of violence - threats, doxxing, or content inciting violence against identifiable individuals or groups.
  • Fraudulent sales - fake shops, payment scams, relationship scams, dishonest investment offers, or other misleading ways of taking money.

Content Ownership

Your content is yours. We don’t claim ownership over anything you build with Tilkly.

You retain full ownership of all content you create and publish through Tilkly. By publishing content you grant us a limited, non-exclusive, royalty-free licence to host, store, and deliver that content solely to operate and improve the Service.

We do not claim ownership over your designs, text, images, or any other materials you upload.

AI-Generated Content

AI outputs are machine-generated. Review everything before publishing - accuracy is not guaranteed.

a. Made-up template content. All public template examples on tilkly.com are created with AI. Names, businesses, addresses, phone numbers, email addresses, photos, and places shown in them are made up. Any similarity to a real person or organisation is accidental.

b. Content made for you by AI. When you use Tilkly’s AI helpers, you are responsible for checking the result before publishing and making sure it follows the law.

c. AI can make mistakes. AI may provide incorrect or invented details. Tilkly cannot promise that AI-created content is accurate or suitable for your needs.

d. Right to request removal. If you believe AI-generated content on this Service appears to identify you personally, contact legal@tilkly.com with: (i) a description of the content; (ii) the URL; and (iii) why you believe it relates to you. We will review and, where warranted, remove it without undue delay.

e. Limitation of liability for AI content. To the maximum extent permitted by law, Tilkly is not liable for any claim arising from AI-generated content that incidentally resembles real persons, places, or entities.

f. AI service. AI helpers use Google Gemini’s paid service. Google states that your descriptions are not used to train its models. Please avoid adding personal, sensitive, or confidential information.

Section 6

Payments, AI Credits & Stripe Connect

All payments are processed by Stripe. By paying or receiving payments through the Service you agree to Stripe’s terms.

a. AI credits. One pack contains 50 credits and costs €7 as a one-time purchase. Credits do not expire, are prepaid and non-transferable, have no cash value, and are non-refundable once consumed. The pack may be purchased again when needed. We may revoke credits obtained through fraud or chargebacks.

b. Support contribution. Support Tilkly is a voluntary, non-recurring €5 contribution. It grants no feature access, extra capacity, priority support, service-level agreement, or service entitlement. It may be repeated. Refunds remain subject to applicable consumer law, and fraudulent or disputed contributions may be reversed.

c. Visitor payments via Stripe Connect. If you connect your Stripe account to accept visitor payments, you are the merchant of record. You are solely responsible for the goods or services you sell, tax collection, refund policies, chargebacks, and your own GDPR/CCPA compliance towards buyers.

d. Platform fee. Tilkly charges 1% on each successful creator payment processed through Stripe Connect, in addition to Stripe’s own processing fees. The fee rounds up to at least one currency minor unit, so the effective percentage may be higher for very small payments.

e. Cooling-off period. New accounts cannot activate Stripe Connect until at least 7 days after registration and after publishing at least one page. Per-transaction amounts are capped at $100 by default.

f. Prohibited businesses. You may not use the payment feature for any activity on Stripe’s Restricted Businesses list or in violation of applicable sanctions. We may suspend payouts or disconnect your Stripe account if we suspect a violation.

g. Disputes and chargebacks. If a visitor disputes a payment, dispute fees may be deducted from your connected account’s future payouts. Historical payment records may be retained for accounting, tax, fraud-prevention, and legal obligations.

h. Indemnity. You agree to defend and hold Tilkly harmless from any claim arising from goods or services you sell, taxes you fail to remit, or your non-compliance with consumer-protection or data-protection law.

Section 7

What Is Included

Your included allowance covers one published website, 25 pages, one web address you own, 250 MB of images and files, up to 10 MB for each upload, 250 saved contacts, 100 Store products, and 90 days of visitor insights. We warn you after 250 form replies and pause new replies at 500 within 30 days. We warn you after 5 GB of website delivery and may slow large files or pause their delivery at 10 GB within 30 days.

If your contact list is full, you can still edit and download existing contacts. New contacts may pause until you combine, download, or delete some entries. Form replies remain available and can be added to your contacts after you make room.

There is no automatic extra-use billing. We may adjust the same limits for all accounts after reasonable notice and will give you a safe way to handle existing information. Warnings or temporary pauses help keep Tilkly available, and we will not delete existing information only because a limit changes.

Section 8

Your Website Address

When you choose a free Tilkly address, such as yourname.tilkly.com, or connect one web address you own, you confirm that you have the right to use it. You are responsible for buying and renewing your own address with the company where you purchased it. We may reclaim free Tilkly addresses that are misused or left inactive for more than 12 months.

Intellectual Property

All trademarks, service marks, logos, and other proprietary designations of Tilkly are our sole property. Nothing in these Terms grants you the right to use them.

Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranty of any kind. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

Section 11

Limitation of Liability

To the fullest extent permitted by law, Tilkly is not liable for any indirect, incidental, special, consequential, or punitive damages. Our aggregate liability shall not exceed €50 or the amount you paid us in the past 12 months, whichever is greater.

Section 12

Termination

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account from the Account Settings panel. Upon termination, your published sites will be removed within 30 days.

Immediate termination for prohibited content. For any violation of Section 3a, we will immediately and without prior notice suspend your account, unpublish all your sites, delete associated data, and forfeit any unused credits. Such terminations are final and non-refundable. Where the conduct involves criminal activity, we will cooperate fully with law enforcement.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms here and updating the “Last updated” date. Where required by law, we will seek fresh consent. Continued use alone does not constitute consent under the GDPR.

Governing Law

These Terms are governed by French law.

Any dispute is subject to the exclusive jurisdiction of the courts of Toulouse, France, except where mandatory EU consumer law gives a consumer the right to bring proceedings in the courts of their country of residence.

If you find a Tilkly website with a fake sign-in page, harmful download, content shared without permission, impersonation, illegal content, or other prohibited material:

We review every report. Confirmed violations result in immediate site removal. We do not disclose the identity of reporters.
